Insurance Fraud & Workers’ Compensation Investigations in Miami

Most injury claims are honest. The ones that are not cost Florida businesses and insurers millions and raise everyone's premiums. FSO Guard's licensed investigators verify workers' compensation, disability and liability claims lawfully and discreetly, so decisions are made on evidence, not suspicion.

A claim file can contain gaps or conflicting accounts. Those gaps need facts, not assumptions about the claimant. FSO Guard helps employers, carriers and attorneys examine the available evidence in insurance and workers’ compensation matters.

Our licensed investigators serve Miami and South Florida. We document lawful observations, records and interviews in a clear report for the client and counsel.

Red flags that justify an investigation

  • The date or sequence of an injury report needs clarification.
  • Witness accounts differ on a material detail.
  • The file contains unresolved questions about work activity or prior claims.
  • Reported activities appear inconsistent with the restrictions described in the referral.
  • Available records or public posts warrant further verification.
  • A liability claim lacks a clear timeline or supporting scene records.

None of these points proves fraud. An inquiry should test the facts fairly and record evidence that supports or contradicts the concern.

What we do

Activity surveillance

Public observation can document activity relevant to the referral. Video is recorded with time and location information. Reports describe what the investigator saw, without medical conclusions or personal judgments. Mobile assignments may use two investigators.

Claimant background and prior claims

Records work may cover identity, prior litigation, employment and business interests. The scope is tied to the claim and a documented permissible purpose. We use lawful sources only.

Employment and activity verification

When outside employment is in question, we compare available records with field checks and lawful observations.

Social media and open-source review

We can preserve relevant public posts, photos and listings. The record includes source details so counsel can assess their use.

Scene and liability investigations

For premises or vehicle claims, we document the scene, measurements and conditions. We seek witnesses and available camera footage. Prior incident information may provide context.

Witness canvass and interviews

Witness work can include locating people and taking recorded or written accounts. Statements are delivered with the supporting case material.

How the investigation is run

  1. Referral. Provide the claim summary, relevant restrictions, key dates and budget.
  2. Plan. We define the questions and review available records before scheduling field work.
  3. Field work. Investigators carry out the agreed checks and provide daily updates to the adjuster or attorney.
  4. Report. A chronological account links observations to video, records and statements. Delivery is secure. Investigators are available for hearings and depositions.

Rules we follow

We do not trespass or contact claimants under false pretenses. We do not record private conversations without consent. Tracking and access to protected records require lawful authority.

Each assignment starts with a written agreement and a documented lawful purpose. Counsel can review the proposed scope and the intended use of the evidence.

FAQ

Frequently Asked Questions

Is it legal to put a workers' comp claimant under surveillance?

Yes. Observing and recording a person in public places where there is no reasonable expectation of privacy is lawful in Florida, and it is standard practice in claims investigation. We do not trespass, do not record audio without consent, do not contact the claimant under pretext and do not use GPS trackers on vehicles we have no right to track. Evidence gathered that way is what holds up before a Judge of Compensation Claims or a jury.

What does a claim investigation include?

Depending on the case: a claimant background and prior-claims review, employment and activity verification, planned activity surveillance with time-stamped video, canvassing and witness interviews, a lawful review of public social media, scene documentation for liability claims, and a written report with exhibits. Attorneys often add recorded statements and testimony.

Who hires you for these cases?

Employers (especially self-insured companies and those with high experience mods), insurance carriers and third-party administrators, defense attorneys, and occasionally claimants' attorneys who need an independent scene investigation. All work is performed under a written agreement with a documented lawful purpose.

How many days of surveillance are needed?

Usually two to three well-planned days produce a clear picture: a claimant who is genuinely disabled looks the same on every day, and one who is not usually reveals it quickly. We plan around the claimant's known routine, medical appointments and deposition dates, and we stop when the evidence is conclusive, either way.

Can you investigate other insurance claims?

Yes: property and auto liability claims, slip-and-fall and premises liability, staged accidents, disability claims and life insurance contestability investigations, as well as fraud by contractors or public adjusters. Each is scoped individually.
